The relationship between the parties is governed by the Romanian Law on consumer protection (Law 363/2007), the law on electronic commerce (Law 365/2002) and the Internet shopping ordinance (Ordinance 130/2000).


Contract -the purchase contract or other contract governed by the applicable law, in which the parties are, the consumer on the one hand and the seller on the other side.

Finalization of the purchase contract -The order made by the buyer is an act with legal effects, provided the order is confirmed and accepted by the seller. From the moment of acceptance of the order by the seller between the parties is concluded a contract with legal effects and with rights and obligations in charge of both parties, as they are defined in the contract or in the general conditions of business, which are integral part of this contract.

Delivery

Warrantycomplaints
The warranty is counted from the date of acceptance of the product by the buyer, and is by

The seller is responsible for all the vices of the product present at the time of delivery or appearing inside the warranty term. A referral must be made in writing or in person. The customer will be reimbursed all costs caused (such as transport costs). The referral is not necessary to be addressed to someone specific, it is enough to be sent to the address specified in the contact section. The referral must contain the description of the reported defect and a copy of the receipt (or any other act demonstrating the purchase). Any referral will be processed without delay and the customer will be informed about the findings made. The referral procedure will be sent to the customer, as soon as the referral has been received.
The guarantee is granted in the following cases:

  • is a defect that can be removed, the product will be partially or totally changed. If the defect cannot be removed due to its disproportionate nature, and the replacement of the product is not possible, the customer will be entitled to a reasonable discount, or the possibility to opt out of the purchase.
  • it is a defect that prevents normal use of the product, replacing it or giving up the purchase.
  • In the case of multiple or repeated defects, replacement of the product or waiver of purchase. The reappearance of the defect exists when the same defect, which prevents normal use, was removed at least 2 times during the warranty period and reappeared. Multiple defects mean at least 3 defects that prevent normal use.
  • Incase of other defects that cannot be removed, and which do not require the replacement of the product, the customer will be entitled to a reasonable discount or waiver of purchase.

In order to benefit from the guarantee, the buyer is obliged to make a referral, and possibly present proof of purchase and the warranty certificate. 
At the request of the customer, the seller will present a written warranty (warranty certificate). Depending on the nature of the case, a guarantee certificate may not be required, proof of the purchase of the product being sufficient For an extended warranty the seller will specify the conditions and extent of it in the warranty certificate. The warranty certificate must contain the name, surname, name of the distributor, registration number, identification code, in the case of legal persons, or domicile in the case of individuals.

case of justified referrals, the buyer has the right to request the reimbursement of any advanced amounts in connection with the complaint (including delivery charges of goods subject to repair). The customer is also entitled to request reimbursement of these amounts if the repair is not carried out.

    In all case of return/replacement of products as a result of waiver of purchase, return/replacement costs are borne by the customer.
    if the product is issued a warranty certificate and the non-compliance is found during the warranty period, the repair measure will be ordered in compliance with OG 21/1992, Law 449/2003 and other legal provisions


    It is recommended that the returned product is in the same condition as it was bought or delivered:

    To have all the components, accessories, including user manual and warranty certificates;
    The product must be returned safely, as far as possible in the original packaging in order to avoid its damage to handling and/or transport. Some products are marked with a seal affixed by the manufacturer on the packaging. This seal is not necessarily present, its presence being specific to the manufacturer. The presence of the seal is not mandatory to demonstrate that the product is exactly in the form and the conditions under which it was issued by the manufacturer. Damage to the seal does not bring any limitation to the right of waiver of the contract
